kishan bagh 2Three persons were killed in BSF firing after miscreants from a minority community attacked the houses of another minority community over alleged desecration of a religious symbol at Kishanbagh, Bahadurpura area in old city of Hyderabad this morning.

Armed with swords and sharp edged weapons a mob attacked the houses and burned several of them injuring at least eight persons after reports that a sacred flag (Nishan Sahib) was burned at Sikh chawni, sources told shajiullahfirasat.com.

It was learned that at least four houses were burned by the rioters as the police looked on.

At least 10 private vehicles were burnt in the violence while a video camera mounted vehicle of the Cyberabad Police was attacked even as police struggled to contain the clash which broke out around 5 a.m.

As per some reports the number of injured is about 20.

The injured were shifted in various hospitals of the city.

One injured is said to be in critical state.

The BSF men resorted to fire unprovoked in a bid to control the situation killing three persons, sources said.

It was alleged that the miscreants attacked  members of minority community with lethal weapons in presence of policemen.

Two of the deceased persons are identified as Shujauddin Khateeb an electrician and Farid a driver by profession who married just one and half month ago.

The identity of the third deceased who was shifted to Gandhi hospital is being ascertained.

Several persons were taken into custody in connection with the incidents of rioting, attacks and arson, said sources.

Soon tension gripped several others areas also as the rumors spread.

Large number of security forces have been deployed, including three companies of rapid action force (RAF), two companies of Andhra Pradesh Special Police, in addition to city police personnel, in the troubled areas.

Prohibitory orders under section 144 enforced in the affected and adjoining areas as a precautionary measure, they said.

Indefinite curfew was imposed in Rajendranagar police station area under Cyberabad Commissionerate in Hyderabad.

MIM President Asaduddin Owaisi demanded arrest of the BSF Jawans who opened fire. He asked the government to set up a probe by a sitting High Court judge into the incident.

Owaisi met Governor’s advisor Salahuddin and demanded stern action against erring jawans.

He also met relatives of the deceased and expressed deep condolences over the killings.

MIM leaders including party general secretary Ahmed Pasha Quadri visited the sport and Osmania hospital where some injured are being treated.

Quadri represented higher officials and demanded stern action against the culprits who attacked members of Muslim community.

The situation is stated to be under control now.

Meanwhile Hyderabad police commissioner Anurag Sharma visited the affected areas and took stock of the situation.

A joint commissioner of police is among the persons injured in stone pelting, Sharma said speaking to newsmen during his visit.

Governor ESL Narasimhan has reviewed the situation and directed officials to ensure that the incident don’t lead to repercussion in other areas of the city, CP said.

We have increased the patrolling in other areas too, he said adding that peace and tranquility prevailed in the city.

Police forced shopkeepers in the other areas of old city also to shut their shops as a precautionary measure.

Meanwhile a MIM delegation led by MLC Aminul Hassan Jaffery represented AP state human rights commission and demanded judicial probe into police firing on innocent youths.

Who ordered BSF men to fire in on innocent people, questioned MIM delegation.

Meanwhile a large number of people attended the the Namaz e janaza and tadfeen of the deceased late tonight amid tight security.

The incident occurred two days before the all important counting of votes in LS and Assembly polls on Friday.

Indefinite curfew was imposed in Rajendranagar police station area under Cyberabad Commissionerate in Hyderabad on Wednesday, following communal clashes and death of three persons in police firing.

Trouble broke out near Sikh Chawni near Bahadurpura, adjacent to the Old City, after miscreants burnt a religious flag in the early hours of Wednesday. Tension gripped the area as members of a community attacked two youths blaming them for the flag burning incident.

Attacks on houses followed while arson was reported in some parts of the area. Cyberabad Police Commissioner C.V. Anand and top officials of Hyderabad Police arrived at the spot and reviewed the situation. Contingents of armed police and paramilitary forces, which were brought to the city for election security, were rushed to the area.

The situation was tense but under control, police officials told The Hindu. Patrolling has been stepped up in other sensitive areas of the Old City as rumours about violence and group clashes spread.

Hyderabad police too deployed armed pickets at strategic points in the Old City to ensure clashes didn’t spread to other areas.

Three killed in police firing

Earlier, three people were killed when police opened fire to control mobs going on a rampage near Kishanbagh in the outskirts of the Old City.

At least 10 private vehicles were burnt in the violence while a video camera mounted vehicle of the Cyberabad Police was attacked even as police struggled to contain the clash which broke out around 5 a.m. Cyberabad Police Joint Commissioner Gangadhar was pelted with stones as he headed police teams moving in the area.

Tension escalated in other parts of Old City as unconfirmed reports said that a youngster was attacked. Even as he was shifted to hospital, heavy stone pelting from both communities continued in the area.

Despite presence of police forces, the two groups started attacking properties. After lobbing tear gas shells, police opened fire on a mob resulting in the death of three persons who are yet to be identified.

The situation in the old city of Hyderabad continued to be tense. A curfew-like situation prevailed in Old city after Clashes between Sikh Muslim on Wednesday morning.

"At least two are dead in the incidents. We are awaiting the autopsy report (to know whether they are killed in firing or in clashes)...but there has been police firing, there is no doubt about that," Andhra Pradesh Additional Director General of Police (Law and Order) V S K Kaumudi told PTI.

Large number of security forces have been deployed, including three companies of rapid action force (RAF), two companies of Andhra Pradesh Special Police, in addition to city police personnel, in the troubled areas, Kaumudi said.

City Police Commissioner Anurag Sharma told reporters: "There was an incident of rioting between two groups and right now the situation is totally under control. We are ensuring that it does not have any other and further repercussions," he said.

"We are ensuring that there is peace and tranquillity in the city. Patrolling vehicles are on the move to maintain law and order. We will ensure that no (such) further incidents take place," he said.

Tension gripped parts of Old City here following clashes between the two communities following which additional forces were rushed there.

Sikhs in Congress India: One war won. Will you be able to erase this nation completely?

On India’s independence the Sikhs opted to remain with India despite offers by the British of separate Sikh state because the Hindu leaders had promised protection of minorities in the forthcoming India. But once free the first reward Sikhs got for their sacrifices for India was the Sikhs were declared a criminal tribe. Indian leaders like Nehru and Gandhi who had even promised a free state for Sikhs shamelessly said, “Now the circumstances are changed.” Worst kind of discrimination started against Sikhs. Sikhism was declared a part of Hinduism. Minority protection rights given by the British were withdrawn. The so called low castes in Sikhism were denied the benefits of SC/ST. Punjabi language was denied its due. River waters were snatched from Punjab. Secret programmes launched to assimilate Sikhism into Hinduism.
The Sikhs launched a peaceful and pure democratic agitation which saw its height in early 80s. At one point of time record number of Sikhs (56000) were jailed. The Govt had no explanation before the international fora and felt embarrassed. Violence was thus  systematically introduced into the Sikh movement to defame it before the international community and handle it through the armed forces. Sant Bhinderanwale a non-political person (though otherwise a dedicated but with militant ideology) was initially projected and encouraged by Govt through its mass media. Was finally encouraged to take refuge in Golden Temple and was wholly surrounded by agents of India’s secret agencies like the IB, RAW and Military Intelligence and was daily briefed and guided by their agents. (Once again I repeat he was sincere to the cause but his view was that Sikhs could get justice through gun only)
Now the Indira Govt got the required stick to beat the Sikhs. Ignoring the sentiments of millions of Sikhs it attacked Golden Temple to capture the Sant it had tactfully created. Sikh sanctum sanatorium was defiled on June 6, 1984 and Sant martyred. But God has his own ways to tackle the tyrants. Indira Gandhi was assasinated on Oct 31, 1984 by her own security guards.
Thus Indira who had planned to massacre Sikhs on a larger scale was herself killed. The massacre plan had to be advanced and brought into action on her murder itself. About 3000 Sikhs were massacred in various states of India especially in Delhi were the security forces remained mute spectators. Congress got the reward and it was returned to power with a record majority in Dec. 1984 because it had launched a massive disinformation campaign against the minority community.
A large number of Punjab youth thus joined the late Sant Bhinderanwale camp and launched militant action. The intelligence agencies immediately joined the militants and carried out a mass killings in Punjab. About 25,000 Sikh youth (according to estimate of Govt agencies) Slowly the agencies strengthened their grip over the movement and crushed it with iron hand when the Govt changed. In tactics they even killed their own sympathisers.
by 1994 the open war with Sikhs  was over and back bone of the Sikh movement was broken. Where Hindu politics and statesmanship had failed the armed forces won.
But the Congress Govt did not stop its anti-Sikh programme. Now in the second phase a cold war launched by Congress centre against the Sikhs has been intensified and the Centre is determined to erase the Sikh element from Punjab and elsewhere. By now (Oct. 2011) the Govt have achieved the following goals:
1.    Sikh representation in Central services have been almost abolished especially in the armed forces and administrative services,
2.    A large scale plan to absorb Sikhism in Hinduism is on. Various deras have been promoted to confuse the Sikhs Controlled Media (all kind of) is also engaged. Some of the deras are claiming membership of more than tens of millions.
3.    Most of the Sikh writers have been brainwashed and are being utilised against the faith. University teachers are being similarly misused. The Communists in Punjab have been extensively used against their own community.
4.    As a result of systematic propaganda the low Sikh growth rate in population has been achieved (less than 1% per annum. 2.1% is minimum where a community can sustain numbers) which means Sikhs will be a minority in Punjab in 30 years. Punjabi farmer is being encouraged to use maximum of poison so that it results in impotency among the population.
5.    About 25 lac migrant labour has arrived in Punjab to substitute the loss of Punjabi population.
6.    Punjab river waters have been fully tamed to be used in the neighbouring states. Punjab farmer is being encouraged to pump the soil water. In about 20 years water table will go down to such an extent that it will not be practical to pump it for agriculture purposes.
7.    Punjab vast industrial sector has been completely ruined and industry shifted to neighbouring states.
8.    Punjab is being encouraged to become a consumer state through propaganda.
9.    Education completely destroyed.  Punjab which stood at 11 place in 1971 census now stands at 18 place (25 place in male literacy) So much so not even 3% of the rural students can get admission in technical colleges of Punjab. To befool people the Govt encouraged mass copying in exams to bring exaggerated results. Similarly corruption and mal-administration allowed in Punjab Board to make it a mere mockery so that the schools opt Central Board.
10.    Completely demoralised and having lost faith in Govt the Punjab youth is fleeing to other countries by hook or crook.
11.    Punjab is named after its five river: Punj Aab but now a sixth river of drugs is flowing in Punjab all with the connivance of Govt agencies. So much so even politicians are also used in it who provide protection to the drug net work.
12.    Sometimes ago Basmati rice from Punjab was exported to USA, the USA food department food the rice as unfit for human consumption as it contained too much pesticides. But in Punjab there are hundreds of commodities where the pesticide content is much more as found on Basmati. As a result of high content of toxic commodities a large number of our youth (boys and girls) are becoming sterile.
13.    Punjab’s politicians are too scared to take up the real local issues. Once the Deputy CM openly revealed that if we take up the issues the Centre will dismiss the state assembly through one pretext. The politicians are living in a constant threat. So much so hundreds of security persons are regularly attached with the Chief Minister of Punjab. When he visits a particular area thousands of security personnel are deployed. Every politician (as a rule) has bee given security of at least half a dozen personnel.
14.    Punjabi the language of Punjab is being reduced to a mere dialect of Hindi. Most schools of Punjab are directly affiliated with Central Hindi boards to make the Punjabi language irrelevant.
15.    A large army of touts have been raised by brainwashing the Sikhs and Communists  who are working against the Sikh interests. Such touts have been exported to other countries where ever there is a sizeable Sikh population. These touts are actively working against Sikh interests on internet.

In spite of all this the  Sikh psyche is in high spirits. They say this is not the first time they facing such a situation. Sikhs saw such times after 1604 AD (When V Nanak assassinated) 1710 (X Nanak assassinated) and 1849 (Lahore annexed by British). They feel they hardly worry of the less numbers. They feel even one person is enough to propagate the philosophy of Guru Nanak. They believe Guru Nanak was one and his unadulterated philosophy survives in the form of Guru Granth sahib. They quote the lines from Jafarnamah of Guru Gobind Singh which he wrote to emperor Aurangzeb  which roughly says like this;
“So what if you have killed all my four sons and thousands of followers, the coiled Cobra is still alive” We believe Sikhs have no danger so long the philosophy of Guru Nanak exists in the form of  “the coiled cobra” the  Guru Granth sahib. A single person can bring revolution like Banda Bahadur did.

USA Declares Punjab’s Basmati unfit for Human Consumption.  Think of poison on gobhi the cauliflower, bataon the brinjal, bhindi the lady's finger on which farmer r spraying 100 times more poison. Does that mean that we are being given slow poison? Especially when the birth rate of Punjabis is 9% agaist the Indian average of 22% and Muslim 36%. We have every reason to allege that this is how Govt is countering the Khalistan movement. We have been crying for years now  how the Indian Govt is not at all exercising any control as to sprinkling of poisons (pesticides/insecticides) on the crops and people are subjected to poisons as a result of which incidence of cancer has gained dangerous magnitude while human infertility has also dangerously increased in Punjab due to poisons. We had cast suspicion on Govt that it is deliberately avoiding any control on poisons so that the population remains in check especially of Punjabis.  Can we say Indian Govt's aproach is in-humane? The Govt id definitely playing as a spectator to  human massacre through pesticides. Every citizen should be aware the dubious schemes of Govt of India.

US blocks Indian basmati import over pesticide traces

The most prestigious market for Indian basmati rice, the USA, has put on hold all consignments of the rice being imported there. In a major setback to Indian basmati exporters, the US Food and Drug Authority has refused to accept basmati being exported to that country, on account of traces of pesticides found in the food grain.

It is learnt that the FDA has refused to allow these basmati consignments to be released to traders for onward distribution to retailers. These consignments, consisting of over 100 containers, have been offloaded and kept at various US ports, while the authorities there analyze the pesticide content in the rice and assess the likely health hazards on its consumption.

This has been done after the FDA seized some samples from 30 containers of basmati rice sent to the US by an Amritsar-based exporter, and found traces of tricyclazole in the grains. The authorities there claimed the food grain had pesticide traces of around 0.02-0.04 ppm (parts per million). Following this, the basmati shipments sent by three other Indian exporters were tested on arrival in the US, and the same amount of pesticide residue was found in those consignments, too. According to sources, not only have the US authorities held up these basmati consignments, but also put the four Indian basmati exporters on the FDA Import Alert 99-08.

The Commerce Ministry is now seized of the matter, and has assured exporters to take up the matter with US authorities. Exporters said unless the Indian Government put pressure on the US government, the Indian basmati could be recalled from retail stores across the US. Their main worry is that the Indian basmati could be included in the product-specific import alert, which could lead to a complete import ban on Indian basmati to the US (India exports about 1 lakh tonnes of basmati to the USA annually). They are equally concerned that this holding up of Indian basmati in the USA, could also have its repercussions on the export of Indian basmati to their largest markets in West Asia.

Exporters here say the USFDA is unneccesarily creating a hue and cry over the issue. “The traces of tricyclazole found in basmati exported to the US, is just 0.02-0.04 ppm. In comparison, the European Union allows a maximum residual level (MRL) of 1 ppm, and Japan allows the MRL of 3 ppm. Indian basmati, with its low MRL, is widely accepted in these countries. Tricyclazole is widely used as a pesticide in most rice-growing countries including India, Thailand, Japan and China,” said a top exporter from Punjab.

SC: Legislature can’t nullify judgments

In a verdict that could have a direct bearing on pending inter-state water disputes, the Supreme Court on Wednesday ruled Parliament and Assemblies had no power to enact laws to nullify judicial verdicts based on facts and findings. “Under the pretence of power, legislature cannot neutralise the effect of the judgment given after ascertainment of fact by means of evidence/materials placed by the parties to the dispute,” a Constitution Bench headed by Chief Justice RM Lodha held.

“A plain and simple judicial decision on fact cannot be altered by a legislative decision by employing doctrines or principles such as public trust doctrine, precautionary principle, larger safety principle and competence of state legislature to override agreements between two states,” the Bench made it clear.

The apex court made the clarification while virtually quashing a law enacted by the Kerala Assembly in 2006, primarily nullifying its verdict earlier that year allowing Tamil Nadu to store more water in the Mellaperiyar Dam across Periyar river.

“The rights of Tamil Nadu, crystallised in the judgment dated 27.2.2006 passed by this court in WPC No. 386/2001 cannot be nullified by a legislation made by the Kerala State legislature,” the Supreme Court ruled.

The other judges on the Constitution Bench were Justices HL Dattu, CK Prasad, Madan B Lokur and MY Eqbal.

The SC acknowledged that under the Constitutional principle, the legislature had the power to render judicial decisions “ineffective by enacting validating law within its legislative field fundamentally altering or changing its character retrospectively.”

But this power “has no application where a judicial decision has been rendered by recording a finding of fact... A (judicial) decision which disposes of the matter by giving findings upon the facts is not open to change by legislature. A final judgment, once rendered, operates and remains in force until altered by the court in appropriate proceedings,” the SC explained.

The Bench said it was true that the state’s sovereign interests provided the foundation of the public trust doctrine, but the judicial function was also a very important sovereign function of the state and the foundation of the rule of law. As such, the legislature had no right to cite any doctrine or principle to “directly or indirectly set aside the authoritative and binding finding of fact by the Court.”

    The SC held the 120-year-old Mullaperiyar Dam was safe and allowed the Tamil Nadu Government to raise the water level to 142 feet and ultimately to 152 feet after completion of strengthening measures on the dam
    It pulled up the Kerala Government for enacting a law that overruled its 2006 verdict by which it had declared the dam safe and allowed Tamil Nadu to raise the water level
    A final judgment, once rendered, operates and remains in force until altered by the court in appropriate proceedings, it said.

In a major victory for Tamil Nadu, the Supreme Court on Wednesday declared as unconstitutional the law passed by Kerala in 2006, constituting the Dam Safety Authority to prevent the State from raising the water level in the Mullaperiyar dam from 136 ft to 142 ft.

A five-judge Constitution Bench of Chief Justice R.M. Lodha and Justices H.L. Dattu, C.K. Prasad, Madan B. Lokur and M.Y. Eqbal, allowing the suit filed by TN permanently restrained Kerala from interfering with the rights of Tamil Nadu from raising the water level in the dam from 136 ft to 142 ft.

Justice Lodha, who wrote the judgment, also restrained Kerala from enforcing its law on Tamil Nadu. By enacting the law and fixing the storage height of the dam at 136 ft, Kerala had nullified the 2006 judgment and usurped judicial power and thus interfered with the judicial functioning.

The Bench said the Constitution envisaged separation of powers among the Executive, Judiciary and Legislature and one should not encroach into the domain of the other. Independence of the judiciary and courts alone would ensure rule of law, the Bench said.

The Bench said a legislation could be invalidated on the ground that there was a breach of separation of powers in enacting the law, though the Legislature might have the competence to do so. The Bench said “If the court finds that there was transgression of constitutional principles in separation of powers the court can declared the law void.”

The Bench said the Legislature could only amend the law but could not invalidate a judgment or a decree passed by the court. The law enacted by Kerala legislature was an attempt to interfere with the judicial functioning, the Bench said and struck the law as unconstitutional and void.

The Bench appointed a three-member committee with chairman of the Central Water Commission as the chairperson and representatives from the States of Kerala and Tamil Nadu to supervise and ensure that the water level in the Mullaperiyar dam was raised up to 142 ft.

Eight-year wait ends

To allay the apprehensions of Kerala, though none exists, the Bench said the committee should make periodic inspection of the dam, before the monsoon and during the monsoon and take all steps necessary for the safety of the dam. The Kerala government was directed to allow Tamil Nadu to carry out all repairs and take all other steps for the safety of the dam. On a suit filed by Tamil Nadu, the apex court in 2006 permitted the State to raise the water level from 136 ft to 142 ft. Within 15 days of the verdict, Kerala enacted a law and constituted Dam Safety Authority to prevent Tamil Nadu from raising the water level beyond 136 ft. In April 2006, Tamil Nadu filed a fresh suit to declare the law as unconstitutional. On Wednesday, after eight years the apex court decreed the suit in favour of Tamil Nadu.
